What are the laws in NC regarding CNA to resident ratio in a nursing facility?

I am a Certified Nursing assistant in NC. I work night shift,we rarely have enough help. This is a 104 bed facility a lot of times it is just me and one other CNA to take care of all these residents. Is this legal?Of course we have 2 LPNs there but they mostly do charting and do not have much time for actual patient care. This is not fair to the residents who live there and their families who pay as much as 4 thousand dollars a month.I really try my best to make sure these people are taken care of ,but there is only so much I can do. Could I be sued if something happened to one of my residents?I know these people are not getting adequate care.So what can I do?

Your nursing home should have this info posted for residents and their families to veiw. If they do not have this info check the states government websites or you can contact your local government officials. Usually the concern is about Registered nurse to resident ratio. When you were certified did you receive paper or info about being certified? The ratios may also be in that literature.

I asked State during our inspection and they said there aren’t restrictions anymore, this is in TX by the way. She said it depends on the quality of care and the incidents and such. Crazy huh?

Here is some info that I found about staffing in north carolina.
The state registry may also tell you more about the requirment for staffing in your state. Contact for the state registry
